No.
You are immune from liability as specified under the
terms of the Good Samaritan act.

What
does the law do?
The
law protects good-faith food and grocery donors from
civil and criminal liability should the product later
cause harm to the recipient.

Who
is protected?
The
law protects all food and grocery donors including indivuals,
corporations, partnerships, associations, government
entities, wholesalers, manufacturers, retailers, farmers,
gleaners, and non-profit feeding program administrators
acting in good faith. While exceptions are made for
gross negligence, the law states that test groups will
not be liable.

What
sort of donation is protected?
The
act provides protection for food and grocery products
that meet all quality and labeling standard imposed
by federal, state, and local laws and regulations. This
includes products that may not be "readily marketable
due to age, appearance, freshness, grade, size, surplus,
or other conditions."

Who
We Are
Merced
County Food Bank is a private non-profit organization
that grew out of community collaboration to feed the
hungry in the local area. A board of Directors consisting
of representatives from most of the cities in Merced
County are responsible for running the Food Bank.
The Food Bank is in partnership with 35 area pantries
and manages 17 USDA food distribution sites. In addition
the Food Bank is in the second year of administering
the Senior Brown Bag Program providing food to very
low-income elders.

Why
We Exist
There
are more than 45,000 people, many of them children and
seniors, living below the poverty level in Merced County.
Merced County Food Bank serves as a communal bridge
between those in need of food and those who are willing
to share what they have.
